This Photography Services Agreement (“Agreement”) is entered into between Michael Kerr Photography (“Photographer”) and the undersigned client (“Client”) for the provision of photography services on the terms outlined below.
- Ownership and Usage Rights
All photographs taken by the Photographer remain the sole intellectual property of Michael Kerr Photography.
The Photographer retains full copyright and reserves the right to use any image from the session for promotional purposes, including but not limited to advertising, social media, portfolio display, and website content.
- Liability
The Client agrees that the Photographer shall not be held liable for any injuries, accidents, or damages incurred during the course of the photoshoot, regardless of location or circumstance.
- Deposit and Payment
A non-refundable deposit of $20 CAD is required to secure the session date.
The deposit must be sent via e-transfer to: michaelkerrphotography@outlook.com.
The remaining balance is due on or before the day of the photoshoot, unless otherwise agreed in writing.
- Cancellation Policy
Cancellations by the Client will result in the forfeiture of the deposit.
If the Photographer must cancel for any reason, the Client may choose to receive a full refund of the deposit or reschedule the session at a mutually agreed date.
- Editing and Retouching
The Photographer will perform basic editing, including color correction, exposure adjustments, and cropping.
Light retouching (e.g., blemish removal, skin softening) may be included at the Photographer’s discretion.
Extensive or custom edits (e.g., background removal, body modification) may be subject to an additional fee.
The Photographer does provide unedited images chosen by the Photographer
Final images are delivered as high-resolution JPEGs. Turnaround time is typically 2–3 weeks from the session date. Rush edits may be available for an additional fee.
- Image Delivery and Selection
The Photographer will deliver a curated selection of final edited images. The Client will not receive all photos taken during the shoot. Final images will be delivered digitally via an online gallery or download link, depending on the session type and agreement.
- Client Cooperation
The Client agrees to arrive on time and be prepared. Late arrivals may reduce available shoot time.
The Photographer is not responsible for appearance-related concerns including clothing, hair, makeup, or facial expressions.
- Weather and Location Conditions
For outdoor sessions, the Photographer reserves the right to reschedule in case of poor weather or unsafe conditions.
The Client is responsible for obtaining any permits or permissions required for a specific shoot location.
- Archiving and File Storage
Final images will remain available for download for 60 days after delivery.
The Photographer is not required to store or archive images beyond that period. Clients are encouraged to back up all files promptly.
- Model Release
The Client grants the Photographer and its legal representatives, heirs, and assigns the unrestricted right to use and publish photographs of the Client (and their likeness) for editorial, trade, advertising, and lawful promotional purposes.
- Agreement & Acknowledgment
By signing below or agreeing to the terms upon booking, the Client acknowledges that they have read, understood, and agreed to the terms and conditions stated above. This Agreement is binding as of the date signed or submitted.
